These terms and conditions are agreed between DAZZ and any person wishing to make a purchase through this site, hereinafter referred to as the “USER”.

These conditions apply exclusively to individuals and not to merchants.

By using this site or making a purchase through it, the parties agree that their relationship will be governed exclusively by the general terms and conditions and policies described herein. BY USING THIS SITE, THE USER ACCEPTS THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THEM, YOU SHOULD NOT USE THIS SITE. We therefore advise the USER to carefully consult this document BEFORE using the site to make a purchase.

We may also change these Terms and Conditions periodically. Whenever you intend to use our site, you should check these Terms and Conditions to ensure you understand the terms applicable at that time. We also advise you to consult the Privacy Policy.

These conditions apply for the entire duration of the services offered by DAZZ.

ARTICLE 1 – OBJECT

These terms and conditions aim to define the general sales conditions established between DAZZ and the USER, from the moment of ordering to the various services provided by DAZZ, such as payment methods and the conditions for delivery of goods and exchanges or returns of purchased products.

ARTICLE 2 – PRODUCTS

The items offered for sale are presented and described with the utmost accuracy. If, despite our precautions, any errors occur on the site, DAZZ cannot be held responsible for this fact.

Please note that, in some cases, the colors of the products shown on this site and the color of the delivered products may differ slightly – this is due to the fact that the color balance differs from screen to screen.

All products benefit from a contractual guarantee, without prejudice to the legal guarantee (14 days). The legal guarantee also applies to non-conformities arising from packaging. In the event of receiving a defective product or an open or damaged package, the USER must report the fact, providing their order number and a description of the defect via email to info@dazzcolllection.com or by mail to the address above. DAZZ will take steps to resolve the matter as quickly as possible and reasonably, in direct contact with and with the agreement of the USER.

ARTICLE 3 – PURCHASES

The minimum purchase amount on this site is €20 (twenty euros), including VAT.

To make a purchase on this site, and if you are a new USER, you must register (see Article 7 below). By making a purchase, understood as the moment of payment, the USER unequivocally expresses their full acceptance of these Terms and Conditions, and of all information provided regarding the price, reference, weight and description of the product(s) they have chosen to purchase, which are included in their order form.

To register on this site, you must provide your personal data, such as your name, address, email address, among others, which will be requested in the order form, and you must fill in all the mandatory fields. The USER agrees that the content provided when registering on this site is not misleading and is true, accurate and complete in all respects, and that they will inform DAZZ, or update their data, in their private reserved area, whenever there is a need to update it.

It is agreed between the parties that any dispute regarding these points will be resolved based on the direct exchange of information and with all the guarantees mentioned in this document. In the event of unavailability of an ordered product, DAZZ undertakes to immediately inform the USER via email or telephone and to reimburse any amounts paid within a maximum period of 30 (thirty) days from the date of knowledge of the unavailability.

ARTICLE 4 – PRICES

Prices are in euros (€), including taxes and duties. The prices shown include VAT applicable on the day of the order. Any change in the applicable VAT rate will always be reflected in the product prices.

Product prices and specifications are subject to change without notice. During the processing of your order, any pricing errors that may be displayed on the website due to technical anomalies will be detected. In this situation, the USER will be contacted. If the product price displayed on the website is actually lower, the difference will be refunded. If the price is higher, the USER will be contacted and may accept or cancel the order.

ARTICLE 5 – PAYMENT

Payment can be made through various available methods (Multibanco, MBway, PayShop, PayPal, credit card and bank transfer) on this site, at the end of the purchase process (checkout). You can see a brief description of how each one works in “Frequently Asked Questions / Payment”.

By completing the payment process and clicking the “Finalize order” button, you are making a binding offer to enter into a purchase contract; however, all orders submitted by the buyer are subject to our acceptance and at our sole discretion. We are free to refuse your order, at our sole discretion, for any reason, without liability and in accordance with applicable law. Examples of situations in which we may not accept your order, among others:

a) unavailability of products presented on the website and/or incorrect price or description
d) if we cannot obtain authorization or validation of your payment
f) if there is reason to believe that you have violated these Terms and Conditions
h) if we have reason to believe that you are not a consumer but a commercial buyer

If we cannot accept your order, we will inform you and will not charge you for the product.

The final validation of the order, in accordance with legal provisions, constitutes proof and allows the enforceability of the amounts shown on the order slip. The validation is valid with the signature and acceptance of all operations carried out on the website.

In any payment method, the USER has 24 hours to make the payment. After this period, the shopping cart will be empty and your order will be void. Remember that we will only proceed with the shipment of your order after we have received your payment.

ARTICLE 6 – SHIPPING COSTS

Shipping is available for mainland Portugal and the islands (see list).

The ordering system automatically calculates shipping costs.

International services are not exempt from compliance with customs regulations established for the clearance and entry of goods into the destination countries.

All shipments destined for non-EU countries will go through customs, which may affect their transit. Any customs clearance fees must be paid by the USER, and some type of documentation may be requested. DAZZ will inform the USER if any payment is required.

ARTICLE 7 – ORDER ACCEPTANCE AND DELIVERY

All orders received before 12:00 PM will be shipped the same day. Any order received after 12:00 PM will be processed and dispatched the next business day. Any order received on Saturdays, Sundays, and public holidays will be dispatched the next business day. Delivery times vary depending on the destination (see table).

Delivery of purchased products can be made to the address indicated by the USER, simply by indicating the address in the corresponding fields of the online order form.

Delivery will be made by the carrier. If you are not present at the indicated address, a notice will be left informing you of the attempted delivery. The courier will contact you to schedule a new delivery of the order.

IMPORTANT: Delivery will under no circumstances be made to post office boxes.

ARTICLE 8 – RETURNS AND EXCHANGES

According to the legislation in force in the European Union, all items can be exchanged or returned except those that state otherwise. In the unlikely event of any complaint regarding any products purchased on this site, the USER has a period of 30 (thirty) days from the date of receipt of the order to exchange or return the ordered items.

If there is a lack of conformity, the USER may return the items and may choose between replacement or termination of the contract, under the applicable legal terms.

NEVER return the item without first contacting DAZZ. Our team will inform you of the correct procedure and steps to take. In all cases of exchange or return requests, the USER must contact our Customer Support Service using the address above; or via email info@dazzcollection.com; Or you can call +351 253 303 404, Monday to Friday from 10:00 AM to 5:00 PM.

You can return or exchange the item provided it is in the same condition as when it was sold, with original labels and packaging and accompanied by all its accessories.

The USER has two options for exchanging or returning the item:
1) directly at the DAZZ counter, Edifício Quinta da Granja, Av. Dr. Sidónio Pais, Loja 185, 4750-333 Barcelos, Portugal

or
2) via courier, which can be contracted directly by the USER or the USER can use the contract that DAZZ has with its own courier.

The USER must properly pack the item(s) and bear the shipping costs (if using our courier, this cost will be communicated at the time of return).

The usual procedure for the USER to make an exchange or return is as follows:
a) The USER must contact our Customer Support team, stating their request and details of what they wish to do (exchange or return).
b) The USER must send a clear photo or video of the damaged or defective product and the shipping packaging.
c) Our team will analyze it before we can consider issuing authorization to send the product back to us. Use good lighting and a close distance so that we can identify and verify the problems. Send the photo to info@dazzcolllection.com.

In case of an exchange, if the new order is more expensive, the USER will have to pay the difference, either by adding the remaining payment to the exchange request or by paying it when picking up the new order.

In the case of a refund request for an item purchased at a reduced price due to a special offer, DAZZ will refund the amount actually paid by the User and not the full amount at the time of return.

In the case of a return, the refund of your purchase amount will be made after validation of compliance with the return conditions described above, with DAZZ having a period of up to 15 days to do so from the moment the item(s) are received at the warehouse.

ARTICLE 9 – MINORS

The use of our site by a minor (under 18 years of age) is strictly subject to the consent of their parents or legal guardians. We strongly advise parents who authorize their children to use this site to discuss with their children all aspects of online safety and the potential risks associated with it.

ARTICLE 10 – CONSEQUENCES

If we suspect, become aware, or have reason to believe that the user has violated any of the provisions of these Terms and Conditions, we may (without prejudice to our other rights and remedies) immediately take such action as we deem appropriate, including:
a) Immediately, temporarily or permanently suspending the USER’s right to use this site
b) Immediately, temporarily or permanently deleting any publication or material uploaded by the USER to our site
c) Issuing a warning to the USER
d) Disclosing information to law enforcement authorities, to the extent reasonably necessary

ARTICLE 11 – LIABILITY

DAZZ has only an obligation of means regarding the phases of access to the site, ordering process, delivery of products and subsequent services, excluding any liability for any inconveniences or damages inherent to the misuse of the Internet, in particular service interruptions, external intrusions by hackers or malicious computer viruses.

Except for any warranty cases, any transaction carried out between DAZZ and the USER, when not contested within 90 (ninety) days from its completion, cannot give rise to any claim.

ARTICLE 12 – INTELLECTUAL PROPERTY

All data and content on this site are the property of DAZZ and are protected under general law and by national and international legislation on the protection of Intellectual Property. The total or partial reproduction of the content, identity, or ideas for commercial purposes, or their distribution or incorporation in any other physical or online location, regardless of the format, is strictly prohibited. Furthermore, none of these articles, or any others, may be reproduced without the prior authorization of DAZZ.

USERS who have a personal website and wish to place a simple direct link to www.dazzcollection.com on their site for personal use must request authorization from DAZZ. This will not constitute an implicit agreement of affiliation or partnership.

On the other hand, any hypertext link directed to the website www.dazzcollection.com using framing or in-line linking techniques is strictly prohibited.

In all cases, any link, even if tacitly authorized, must be removed upon a simple request via email from DAZZ.

ARTICLE 13 – ENTIRE AGREEMENT

These “Terms and Conditions” constitute the entire agreement between the parties.

Should any clause of these conditions become null and void due to a legislative or regulatory change or court ruling, this shall not affect its validity and enforceability in any way.

ARTICLE 14 – PROOF

The computerized records, kept securely in DAZZ’s computer systems, are considered proof of communications, orders, and payments made between the parties.

ARTICLE 15 – STORAGE AND ARCHIVING OF TRANSACTIONS

The archiving of orders and invoices will be done on a reliable and durable medium to ensure a faithful and lasting copy.

ARTICLE 16 – APPLICABLE LAW JURISDICTION

These Terms and Conditions and other policies published on this site are governed by Portuguese law. Any legal issues arising from these Terms and Conditions will be resolved by the courts of Braga, Portugal, with express waiver of any other jurisdiction.

Alternatively, in the event of a consumer dispute, the consumer may resort to the European Online Dispute Resolution Platform or to the following alternative dispute resolution entities for consumer disputes.
